๐ About the role
Re-advertised State Advocate post in the Specialised Tax Unit (STU) at the NPA's DPP: Kimberley office. The advocate prosecutes tax and commercial crime matters, guides complex investigations and travels to courts across the province when required. Post 35/120 in DPSA Circular 35.
โ Key duties
- Study case dockets and decide on instituting prosecution
- Guide investigations in complex tax and commercial matters
- Prepare cases for court and draft charge sheets, indictments and court documents
- Present the State's case, lead and cross-examine witnesses, address court on conviction and sentence
- Manage court and case flow independently
- Deal with appeals, reviews, opinions and heads of argument
- Appear in motion applications on criminal matters
- Mentor and guide investigating officers, prosecutors and stakeholders
- Assist with high-profile tax matters and keep records, statistics and reports
- Consult regularly with stakeholders including SARS officials
๐ Requirements
- LLB (serving prosecutors seeking promotion: any appropriate legal qualification)
- Right of appearance under section 25(2) of the NPA Act
- At least 5 years' post-qualification legal experience
- At least 5 years' relevant criminal court experience in advocacy and drafting
- Extensive prosecution experience in fraud, theft, forgery and uttering, and commercial crimes
- Ability to mentor and train prosecutors and stakeholders
- Good interpersonal, analytical, organisational and communication skills; computer literacy
- Willing to travel to courts across the province
- Valid driver's licence
